Access Benton County Court Records

Most Benton County court records sit with the clerk of the court that heard the case, so that office is the place to start. The file can hold the docket, pleadings, orders, and judgments. Some of it is public, and a good deal can be viewed online. What you need is a case number, a document name, and a choice between a plain or certified copy. Benton County court records also split by court, since Circuit Court, Probate, and the local District Court each keep their own files.

How to Get Court Records

Begin with Search ARCourts. Write down the full case number, the court, the event date, and a description of the document. If a Benton County event shows a released image link, open it. Save only what is lawfully public. When an image is missing, that points you back to the custodian. Do not read it as proof that the filing is sealed.

  1. Identify the case and exact filing, order, judgment, or event list needed.
  2. Call the right Benton County custodian: Circuit criminal at 479-271-1016, civil or domestic at 479-271-1015, Probate at 479-271-5727, or the named District Court.
  3. Choose a plain informational copy or a certified copy and ask for page count, fees, payment method, delivery channel, and turnaround.
  4. Request in person or by mail as the clerk directs. The Circuit Clerk receives mail at 102 NE A Street, Bentonville, AR 72712.
  5. Call Archives at 479-271-1710 for an older circuit file. Ask the assigned court reporter about a transcript.

Arkansas Supreme Court Administrative Order No. 19 chiefly governs a formal Benton County court-record request. Call or visit the counter. The staff can walk you through the steps. A public terminal may exist in person. Benton County promises no location, so phone first. The fax line at 479-271-5719 is not automatically an approved formal filing or copy order. The clerk's entrance drop boxes are documented for filings only. They are not a guaranteed way to request copies.

Three Benton County Court Records

People call three things "the record" in a Benton County file. They are not interchangeable. The docket is simply the index of case events. Filed documents are the motions, pleadings, orders, exhibits, and judgments behind those entries. A certified copy is different still: a clerk-attested reproduction for when official proof is required.

A Search ARCourts printout is not the certified official Benton County court record. Treat it as a tool to identify the document. Then order the copy you actually need for official use.

Types of Court Records

Benton County Circuit Court records cover felony, major civil, domestic-relations, juvenile, and District Court appeal files. Probate belongs to Circuit Court work, yet the elected County Clerk administers it locally. District Court clerks hold the traffic, misdemeanor, ordinance, and qualifying civil or small-claims records.

  • Docket sheets and chronological case-event lists
  • Complaints, petitions, answers, motions, responses, and notices
  • Orders, decrees, judgments, dismissals, and appeal filings
  • Public charge, plea, sentence, and disposition material in criminal cases
  • Public exhibits and attachments when not sealed or restricted
  • Transcripts created by the court reporter rather than copied from the clerk's file

Record type shapes both access and custodian in Benton County. A public docket entry can exist while its attached image stays restricted. Transcripts are separate too. A hearing transcript runs through its own court-reporter process.

Benton County Has Four Record Counters

The Circuit Clerk serves as the official custodian for Benton County Circuit Court, with a counter at 102 NE A Street and separate civil or domestic and criminal phone lines. County Clerk Probate sits in Courthouse Room 206. Each local District Court clerk keeps that court's own lower-court files. Older Circuit Court material goes through Archives.

What a Court Record Contains

Contents vary by case type in Benton County. Still, the public file usually holds a header plus a sequence of filed or entered material. Read the docket first, since it ties each requested document to its exact date and description.

Case NumberThe complete court-assigned identifier and key for a precise request.
Case HeaderCourt, type, filed date, status, case description, and sometimes judicial assignment.
PleadingsPetitions, complaints, answers, motions, responses, and other filed requests.
Orders and JudgmentsSigned rulings, disposition documents, decrees, sentences, or dismissals.
Docket SheetThe chronological list of filings, service, settings, actions, and results.
ExhibitsAttachments or evidence when filed and available at a public security level.

Financial details may sit in a bookkeeping or payment system instead, and public view may be incomplete. Redacted identifiers and restricted documents deserve to stay protected.

Benton County Written Request Fields

Benton County offers no single official web form covering every court-record request. Its public-records coverage page helps you see what is already online. Check it before you ask. A clear written request helps the clerk find the right file. The clerk can then quote the work before payment. Send it to the court custodian, not to a random county department.

Benton County Archives Holds Older Files

Online images do not reach every old Circuit Court record. Benton County lists a distinct Archives line, 479-271-1710. Call ahead. Give the full case number, court, approximate date, and the document you want. Staff can say whether retrieval is needed. They can also say whether a fee applies. The county publishes no official archive search amount. The Archives desk also closes at noon, unlike the general court counter. Digitization has not erased paper and archive work. Search ARCourts can still supply the index that frames a request. An older image may take staff retrieval and a clerk copy.

Certified Copies and Fees

The Circuit Clerk's court-fee page routes you to its Revised Fee Schedule 2026. A plain pleading or court-document copy runs $0.25 per page. Certification adds $5 plus the copy pages. Authentication costs $5 plus any copy and certification charge. Note that these are Circuit Clerk copy fees, not filing fees. They are not a universal District Court price either.

The Benton County fee schedule accepts cash, personal or business checks, cashier's checks, and money orders. The clerk FAQ adds credit and debit, excluding American Express. Confirm the current total and payment method before you send funds.

Order Benton County Certified Judgments

Benton County does not run one shared web order form for certified judgment copies. So start by writing down the case number and judgment date. Then phone the right clerk. Say you need certification, and ask about page count, total cost, payment options, mailing steps, and turnaround. Checks go to BCCC and should carry your driver's-license number and phone. Skip emailing card details unless the clerk offers a secure method. One more caution: a portal printout plus a notary stamp is not a certified copy. Only the clerk that keeps the file can certify it.

Benton County Transcripts Use Court Reporters

A transcript comes from a court reporter's record of a hearing. It is not a photocopy, and the clerk's per-page copy schedule never applies to it. Contact the reporter for your Circuit division. Name the case and proceeding date, and ask for a quote and the reporter's process. A docket entry proving a hearing happened does not promise a transcript exists. Ask what source record survives and what deposit or order is needed. Start with the county's Circuit divisions directory to find the assigned division.

Benton County Drop Boxes Are for Filing

The Circuit Clerk's notice lists drop boxes at the Courthouse and Administration Building entrances, plus mailed filings at 102 NE A Street. Those are filing channels only. Nothing about them creates a copy-order service. Never drop cash or a sensitive record request into a box unless the clerk confirms it first. For copies, call the records desk and follow what it says; treat fax the same way. That small habit keeps a request out of filing intake, which was never built to count copy pages, handle certification, postage, or access rights.

Public Access and Sealed Records

Administrative Order No. 19 governs access to Arkansas court records. The Arkansas Freedom of Information Act, Ark. Code Ann. § 25-19-105, covers public records broadly, but judicial authority and Order 19 control the court files themselves. Remote access can be narrower than inspecting records through the custodian.

Key rules:

Administrative Order No. 19 defines court-record access, exclusions, request procedure, and limits.

Ark. Code Ann. § 9-27-309 protects juvenile records in the circumstances stated by law.

Arkansas Rule of Civil Procedure 5(c)(2) supports confidential-information and redaction duties.

Some Benton County material stays closed. Sealed cases, adoption records, protected family material, identifiers, and confidential juvenile files may all be withheld. A docket event with no PDF often just means the image is not public online. Ask the custodian rather than guessing at hidden content.

Benton County Sealed Exhibit Requests

Paying a fee and showing ID never unlocks a sealed exhibit in Benton County. Ask the clerk about the material. Is it public, restricted, older, or tied to a court order? Where a judge must authorize release, use the process attached to the underlying case. Arkansas favors the word "seal." It does not erase the record; it limits ordinary public disclosure under law or order. A partly blacked-out page is not an invitation to rebuild protected facts from elsewhere.

Benton County Clerk Copies Control

For official proof, go to the clerk that keeps the original file. The Circuit Clerk certifies Circuit Court criminal, civil, and domestic records. County Clerk Probate handles Probate. The District Court clerk certifies that court's traffic, misdemeanor, ordinance, civil, and small-claims records. Search first, then request exactly what you need. The Benton County case search will give you the case number and event date. That two-step habit cuts search time. It also keeps public information and certified court records in their proper lanes.
